Intro to Compliance for New Credit Union Compliance Officers: Keeping up with all of the rules, regulations, and laws that affect financial institution operations can be daunting for the most seasoned compliance professional; for new compliance officers, it can be overwhelming. “Where do I even start?” is a question New Compliance Officers often ask themselves. This program will provide resources and information to help answer that question. We’ll highlight the main compliance rules and regulations that affect operations for credit unions. The session also provides some tools and resources new compliance officers can use to help with their duties. 

Supervisory Focus and Update: This session will cover the supervisory focus areas for the CFPB and NCUA for 2024. NCUA’s Letter to Credit Unions 24-CU-01 explains the 2024 Supervisory Priorities for the agency’s 2024 examination program. In 2024, examiners will focus on compliance areas related to overdraft programs, fair lending, auto lending, including a review of indirect auto loans, and compliance with flood insurance rules. It will probably come as no surprise that many of these same issues are areas of concern for the CFPB. We’ll review these topics and discuss ways credit unions can ensure these areas don’t raise red flags when examiners come knocking.

Error Resolution under Regulations E and Z: What happens when a member says there’s an error on their statement? There are very specific rules the credit union must follow, but first, you need to know the nature of the alleged error. Is it an electronic transaction or a credit card transaction? Was the member’s access device (card, PIN, etc.) stolen? Was the transaction unauthorized or was it erroneous? We’ll review the difference between “error” and “unauthorized transfer”, timeframes for investigating allegations of errors and unauthorized transfers, notice requirements, and responsibilities and liabilities of both the member and the credit union. 

Marketing Compliance and Social Media: As much as we would love a “one size fits all” approach to marketing compliance, it just doesn’t exist. Each product and service your credit union advertises may need numerous disclosures that are triggered by what language you use and what loan terms you talk about. However, your credit unions’ advertisements and marketing materials can be clever, colorful, creative, and compliant. This session is designed to address the major rules and requirements for marketing credit union products, with specific attention on the marketing aspects of the 2024 NCUA supervisory examination priorities. We’ll also talk about potential social media traps and why your credit union staff needs social media training. We’ll review some general UDAAP considerations and discuss making risk-based decisions about UDAAP disclosures. 

Combatting Elder Financial Exploitation: Recent news articles and lawsuits related to credit unions and their failure to detect and stop elderly members from losing hundreds of thousands of dollars in various scams highlight the need for credit union employees to recognize the red flags that may indicate elder financial exploitation and for credit unions to have plans in place to help members avoid potentially devastating financial losses. This program is designed to help credit union employees understand and recognize elder financial exploitation and details action steps credit unions can take to help combat the financial exploitation of their elderly members.
Making Compliance Training Fun: We know – “compliance training” and “fun” are not terms often used together. But, if you are responsible for conducting compliance training at your credit union, there are ways you can make that training engaging, interactive, and yes, fun. We’ll talk about some ideas for ways to make sure your staff doesn’t groan and immediately think “boring” when they know compliance training is coming.
Open Discussion and Questions: We’ll end the day with time for attendees to ask questions about compliance issues not addressed during the conference, as well as share ideas about the compliance function at their credit unions.
