On September 4, a letter was sent to Attorney General Sessions asking for the Department of Justice’s help in clarifying website obligations under the Americans with Disabilities Act (ADA).

The letter, signed by Senators Chuck Grassley, Thom Tillis, John Cornyn, Michael Rounds, Mike Crapo and Joni Ernst, outlines strong support for the ADA,  while also highlighting the uncertainty surrounding the impact this law has on websites.  The Senators point out that in the first half of this year, more ADA website accessibility lawsuits have been filed than in all of 2017, and that the lack of regulatory clarity benefits plaintiffs’ lawyers.

Since credit unions across the country have been a target for these types of frivolous lawsuits, we hope the Department will take action on this request.

In their closing, the Senators requested a staff briefing on this topic before the end of the month.  The League will keep you apprised of any updates we receive concerning additional action on this subject matter.
