Day Two will include the following topics with Attorney Todd Sherpy:
Reg CC – Recent changes, changes to come, issues not addressed – yet; and putting it all together.

ODP/Courtesy Pay – The ODP rules from the beginning; the history of regulatory actions and litigation, the lessons learned from ODP Compliance assessments to ensure a full understanding of the issues. Also covered: the specific disclosure obligations, compliance expectations and risk mitigation tools you should consider.

Check Fraud – Understanding and Preventing Exposure & Loss: From the front-line to the back office what you need to know to recognize and prevent loss or to at least mitigate exposure; new standards and issues with MRDC and RDS items together with the new Reg CC rules; common problems from endorsement issues to forgeries; your Credit Union’s duties and options; and practical pointers to help reduce exposure / risk.

BSA – A discussion of where Credit Unions are committing errors; recent examination findings; and practical advice on what to do and/or have in place to receive a passing grade on BSA/CDD/OFAC matters. In Depth coverage: Culture of Compliance; SAR filing in detail; IRS Changes; Treasury CDD rules and expectations; and examination tips. We will also discuss some areas of concern that you may not have considered such as how traditional criminal gangs are changing their focus to white collar crimes that could affect your members.

Elder Abuse: Update and S 2155 Training: Training on Elder Financial Abuse and add the element required to qualify for training per S 2155 in order to take advantage of the immunities offered by the new Act. Also common Credit Unions situations and options; procedures to consider; BSA tie-ins; and other considerations.

Marketing Compliance: There are many errors and misunderstandings regarding aspects of compliance/legal/risk management and marketing/advertising. We will address basic rules as they apply to various media; updates in rules that are often overlooked; options that many may not fully understand; exposures that are present and how to control them; and risk management considerations to also reduce exposures.
